Since incumbent Chief Judge B R Gavai will step down on November 23, the Central Government on Thursday began the process of selecting the country’s next Chief Judge, according to sources who spoke to news agency PTI. Those with knowledge of the process for selecting Supreme Court and High Court Judges informed the news agency that the letter requesting Justice Gavai to nominate his successor is expected to be delivered either this evening or on Friday.<\/span><\/p>\n

The next CJI will be the Supreme Court’s most Senior Judge<\/span><\/strong><\/h2>\n

The seniormost Supreme Court judge deemed qualified to serve as Chief Justice of India must be appointed to the position, according to the memorandum of procedure, a body of rules that governs the appointment, transfer, and promotion of SC and HC judges.<\/span><\/p>\n

In order to choose his successor, the Union Law Minister would “at the appropriate time” ask the departing Chief Justice of India for his proposal.<\/span><\/p>\n

The letter is typically written one month prior to the current CJI’s retirement upon reaching the age of 65.<\/span><\/p>\n

New CJI Justice Surya Kant<\/span><\/h2>\n

The next in line to lead the Indian judiciary is Justice Surya Kant, who is the most senior judge after the Chief Justice of India.<\/span><\/p>\n

On November 24, Justice Surya Kant will be appointed as the next Chief Justice of India. He will serve for over 15 months, till February 9, 2027.<\/span><\/p>\n

Who is Justice Surya Kant?<\/span><\/h2>\n

Justice Surya Kant belongs from a middle-class family and was born in Hisar, Haryana. In 1984, he graduated with a Bachelor of Laws from Maharshi Dayanand University in Rohtak.<\/span><\/p>\n

He started practicing law in the Hisar district court the same year. In 1985, he relocated to Chandigarh to work at the Punjab and Haryana High Court.<\/span><\/p>\n

He was appointed as a Supreme Court judge in May 2019 and focused on civil law, constitutional, and service law issues. In February 2027, Justice Kant is scheduled to retire.<\/span><\/p>\n

How the CJI is appointed?<\/span><\/h2>\n

  1. Process Initiation at least one month before to the incumbent’s retirement- <\/strong>The selection process for the next CJI starts. At this point, the departing CJI’s proposal for their replacement is sought by the Union Minister for Law and Justice.<\/span><\/li>\n
  2. The Seniority Rule- <\/strong>The senior most Supreme Court judge who is deemed qualified for the position is suggested for appointment in accordance with long-standing custom. Since the 1970s, this custom has been upheld to maintain consistency and steer clear of controversy.<\/span><\/li>\n
  3. Fitness Evaluation – <\/strong>According to Article 124(2) of the Constitution, the incumbent Chief Justice is required to confer with other senior judges of the Supreme Court if there are concerns regarding the senior judge’s suitability to serve as Chief Justice.<\/span><\/li>\n
  4. The Last Appointment Process<\/strong> – The Law Minister sends the suggestion to the Prime Minister after it has been made. The President of India receives advice from the Prime Minister. The official notification of appointment is issued by the President.
